The AIDS Health Foundation has called for mandatory use of condoms for any adult film produced in Los Angeles and have accumulated enough signatures to place the initiative on the ballot for June. But the city is looking into whether or not it has the legal authority to enforce the law, should it pass.?
Although there is already a state law requiring condom use, the AHF’s? ?€?Safer Sex In The Adult Film Industry Act?€? would provide additional enforcement. Placing the act on the ballot would cost $4.4 million and city officials are looking to clarify whether the law would actually be enforceable, or if it would be pre-empted? by the state law.
In the meantime, the city has already received threats of lawsuit from the adult film industry with the Free Speech Coalition supporting the industry’s? success in “preventing HIV infections through its testing protocols and self-regulation.” The ? AHF insists, however, that the issue is a matter of public health and that the efforts of the adult film industry and the presence of the state law don’t provide enough…protection. [CNN]
